EXCLUSIVE: The FBI is disputing reports that the bureau has been urging employees to increase the use of warrantless wiretapping on U.S. soil.”Yesterday’s reporting in Wired magazine is a complete misrepresentation of the FBI Deputy Director’s email to the FBI workforce,” a spokesperson told Fox News Digital in a statement on Thursday. “Their allegation that the FBI instructed its employees to violate the law or FBI policies is categorically false and insulting.”At the heart of the issue is the FBI’s use of – and its directions to employees about – the controversial Section 702 of the Foreign Intelligence Surveillance Act (FISA). A Wired report on Wednesday quoted an April email sent out to employees about Section 702 by FBI Deputy Director Paul Abbate, including a portion in which Abbate encouraged employees “to continue to look for ways to appropriately use US person queries to advance the mission.”While the section of Abbate’s email released by Wired emphasized the need for employees to use the tools “properly and in compliance with legal requirements” and to make sure queries into U.S. persons are “fully compliant with the law,” it also appeared to urge more frequent use of the program, arguing that doing so will “continue to demonstrate why tools like this are essential to our mission.”CONGRESS CANNOT LET FISA SECTION 702 EXPIRESome lawmakers immediately took issue with the FBI’s apparent use of Section 702.”The deputy director’s email seems to show that the FBI is actively pushing for more surveillance of Americans, not out of necessity but as a default,” Rep. Zoe Lofgren, D-Calif., told Wired in response to the email. “This directly contradicts earlier assertions from the FBI during the debate over Section 702’s reauthorization.”But the FBI pushed back against Wired’s characterization of the email in the report, issuing a statement to the outlet that accused it of alleging “that the FBI instructed its employees to violate the law or FBI policies.”Instead, the FBI said the email “emphasized Congress’ recognition of the vital importance of FISA Section 702 to protect the American people and was sent to ensure that FBI personnel were immediately aware of, and in compliance with, the privacy enhancing changes the law has put in place.”The controversial 702 program allows the government to tap American companies to collect communications like calls, texts and email without the need for a warrant.A requirement within the program aimed at protecting the privacy of Americans states that at least one of the targeted individuals of a request has to be a foreigner the FBI reasonably believed to not be on U.S. soil.But the Wired report notes that a Justice Department review last year found that the FBI’s compliance rate hovered around 98%, a number that has been touted by FBI Director Christopher Wray and other FBI officials despite it being possible that thousands of its searches were still not in compliance with Section 702 guidelines.Wray defended the program last month, arguing that requiring the FBI to obtain a warrant to scan the database of information under its Section 702 authority would jeopardize its ability to combat national security threats.”If there’s no constitutional, legal or compliance necessity for a warrant requirement, then Congress would be making a policy choice to require us to blind ourselves to intelligence in our holdings,” Wray said during a speech in front of the American Bar Association’s Standing Committee on Law and National Security.The entirety of the email, which was reviewed by Fox News Digital, does lay out changes to current procedures for using Section 702 after President Biden signed H.R. 7888, the Reforming Intelligence and Securing America Act. Notably, Abbate’s email highlights that while there will be no changes to the current law that would require a warrant for queries into U.S. persons, there will be additional protections as part of the pre-approval process in order for FBI employees to make such a query.HOUSE BRACES FOR BATTLE OVER RENEWING CONTROVERSIAL FISA SURVEILLANCE TOOLThe email also highlighted Wray’s effort to maintain the program, with Abbate telling employees that the FBI was able to give concrete examples that demonstrated to lawmakers how the program has helped “prevent attacks, warn victims, and inform intelligence analysis.”In providing the full context of the email to Fox News Digital, the FBI said Abbate was merely highlighting the success of the program and changes to the law, encouraging employees to continue to demonstrate the useful nature of Section 702 while being mindful of compliance with the law.”The Deputy Director was not asking for FBI personnel to find new ways to use the program, but rather to make full use of the tools which have been provided to us by Congress to protect Americans,” the FBI said. “As we have consistently said, U.S. person queries of FISA 702 data are crucial to connecting the dots to identify threat information within our lawfully-acquired holdings.”The FBI also argued that a failure to “fully identify relevant threat information within that data, including through basic analytic techniques such as querying, puts Americans at unnecessary risk from foreign terrorists, spies, and hackers.””Having an attorney or supervisor review queries to ensure compliance before they can be run, as mandated by Congress in the new law, is how we can be confident in higher levels of compliance going forward while we use this vital tool to the full extent allowed by law to protect national security,” the FBI said.Wired did not immediately respond to a Fox News Digital request for comment.

Many Republicans will be shocked to learn that Election Day 2024 happens long before Nov. 5.In fact, it hurts the Republican cause – and the elections of President Donald Trump and House and Senate Republicans – to focus narrowly on Nov. 5.The first election dates are Sept. 16 in Pennsylvania and then Sept. 20 in Minnesota and South Dakota. The next election days are Sept. 23 in Mississippi, and Sept. 24 in Missouri. There are 43 other states and the District of Columbia that follow with their early voting dates. Only Alabama and New Hampshire do not have early voting.CONNECTICUT BECOMES ONE OF LAST STATES TO ALLOW IN-PERSON EARLY VOTINGHere’s an example of why this matters: In 2022, the Republican Senate campaign in Pennsylvania was focused on Election Day in November. The campaign did not begin advertising until long after early voting had started. As a result, 40% of Pennsylvanians had already cast their ballots before the first major Republican ad had aired. This pattern was not unique to that race.Republicans have a history of failing to get the vote out early. This has a compounding negative effect. First, it means Republican turnout on Election Day must be dramatically higher to make up for the number of Democratic votes already in the ballot box. Second, and probably more important, it means that Republican candidates have not been able to focus on the low propensity voters – those who are least likely to turn out.LARA TRUMP SAYS RNC MUST USE ‘LEGAL BALLOT HARVESTING’ FOR FIRST TIME TO STAY COMPETITIVE AGAINST DEMOCRATSThe Democrats have focused on early voting in large part because they want to be able to identify everyone who has not yet turned out. That way, they can focus on phone calls, direct mail, text messages, and even visits to remind those voters that they should vote. They keep it going until the people vote, and their name comes off the list.This long campaign approach has proven for the last decade that it is more likely to win close elections than the focus on the federally designated official Election Day.Shifting Republicans from their focus on Election Day – and their reluctance to vote early – is a major job. Getting it done in one year will require a really focused, determined, and enthusiastic effort. The fact is that, despite all the talk about “Bank the Vote,” it had no discernible impact on the special election for New York’s 3rd District. Republicans lost the early voting decisively and simply could not make it up on Election Day. It wasn’t due to any conspiracy. There was a big snowstorm on Election Day which reduced turnout. The Democrats already had a head start on ballots, so they were fine.COURT STRIKES DOWN EARLY VOTING LAW IN BIDEN’S HOME STATE: ‘A LITTLE BIT OF IRONY’Turning around the Republican attitude, getting people to vote early, and creating a new commitment to win the vote throughout the campaign will require new focus and determination.As my friend and former U.S. Ambassador to Luxembourg Randy Evans suggested in a recent paper, Republicans should start by focusing on “winning day one of voting.”As Evans wrote: “This means identifying the first day of voting of every kind in each State and D.C.; educate GOP voters of that day with an explanation of how to vote that day; set as an objective to win the voting on that day with commitments by Republican voters to show up and win beginning on day one.”Evans then suggested that Republicans should then continue to build momentum by focusing on “winning week one of voting.” As he put it, “To generate momentum this requires full follow-up to all who commit to vote on Day One who fail to do so that we can win Week One. It also involves pushing hard to create a sustainable push throughout early and absentee voting beyond Day One and Week One.”CLICK HERE FOR MORE FOX NEWS OPINIONHe then suggested systematically following up with voters in each state up to their official election days. By Evans’ theory, the cumulative effect of this focus on winning early voting should culminate in winning all the pre-election day activity and, of course, election day voting (which should be a simple cleanup day).The Republican National Committee should establish a set of 51 Election Day countdown clocks that include early voting-to-election day periods for each state and the District of Columbia. President Trump and all the Republican candidates should begin emphasizing early voting.The party and campaign systems should focus on winning the first day of early voting, because it will give them the organization and momentum to continue executing on turnout.Conservative radio and TV hosts and key activists should be encouraged to quit focusing on Election Day and instead focus on winning the early vote in every state. Every time we focus on Election Day, we undermine and weaken our chances of winning the early vote.A serious win from day one approach will significantly increase the likelihood of Republican victories in 2024. The girls were banged up in the process, and at least one was unconscious, she said. The Monroe County Sheriff’s Office told the station they believe the driver was intoxicated. The sheriff’s office did not respond to Fox News Digital’s request for more information.

The White House says it “strongly opposes” a congressional effort to put a citizenship question on the census to prevent non-citizens being counted for congressional apportionment — warning that it would be costly and “make it more difficult to obtain accurate data.”The Equal Representation Act has been introduced in the House and Senate and would require a citizenship question to be put on the decennial census asking whether the respondent is a citizen, a resident non-citizen or an illegal immigrant. The House was due to vote on the bill later Wednesday.The bill would then require that the census not count those who are non-citizens for the apportionment of congressional districts. Currently, everyone who participates in the census, including resident non-citizens and illegal immigrants, is counted for redistricting.SENATE BILL WOULD PUT CITIZENSHIP QUESTION ON CENSUS, STOP NON-CITIZENS BEING COUNTED FOR REDISTRICTINGThe bill would apply to the census conducted in 2030 and comes amid concerns from Republicans that Democrats will benefit from the historic migrant crisis at the southern border that has surged migrants into the U.S. and across the country — including in blue cities and states like Chicago, New York and California.But the White House’s Office of Management and Budget (OMB) said in a statement this week that it ‘strongly opposes” the bill “which would preclude the Department of Commerce’s Census Bureau from performing its constitutionally mandated responsibility to count the number of persons in the United States in the decennial census.” “[The bill] would increase the cost of conducting the census and make it more difficult to obtain accurate data,” the statement said. “It would also violate the Fourteenth Amendment of the Constitution, which requires that the number of seats in the House of Representatives ‘be apportioned among the several States according to their respective numbers, counting the whole number of persons in each State…,’” it read. BIDEN PLAN TO EXTEND OBAMACARE ELIGIBILITY TO ILLEGAL IMMIGRANTS GETS PUSHBACK IN CONGRESS: ‘MADNESS’ Republicans who had introduced the legislation in both chambers had argued instead that the bill would prevent U.S. votes being diluted by illegal immigrants.”It is unconscionable that illegal immigrants and non-citizens are counted toward congressional district apportionment and our electoral map,” Sen. Bill Hagerty, R-Tenn., said in January. “While people continue to flee Democrat-run cities, desperate Democrats are back-filling the mass exodus with illegal immigrants so that they do not lose their seats in Congress or their electoral votes for the presidency, hence artificially boosting their political power and in turn diluting the power of other Americans’ votes.””Incentivizing illegal immigration and exploiting our democracy to skew the number of congressional seats or electoral votes for the presidency is immoral and a sure path to the downfall of our nation. Only American citizens can vote, and only American citizens should be counted when determining federal representation,” Rep. A man threatening residents inside a church in Florida was shot and killed by deputies after “less-lethal options were ineffective” and the man “charged at deputies,” according to the Hillsborough County Sheriff’s Office (HCSO).The deputy-involved shooting happened around 2:40 a.m. Tuesday at the Divine Mercy Prayer Center in Plant City, HCSO said in a press release. Body camera footage from the department shows the man walking behind a wrought-iron fence while growling at the responding deputies. The sheriff’s office said the suspect refused to obey commands to drop a sharp object he was carrying. That object was a railroad spike, according to FOX 13 Tampa Bay. Bodycam footage shows the suspect kicking open the metal fence and lunging at the deputies. At that time, deputies attempted to maintain a safe distance, but the man continued towards them. A BolaWrap, a tool used to restrain a person without harming them, and a Taser were both deployed in failed attempts to stop the unidentified man. “Our deputies showed extraordinary professionalism and exhausted every less lethal option to preserve life before this fatal outcome,” Sheriff Chad Chronister said in a statement. “Their actions today serve as a reflection of the extensive training our deputies undergo and is a testament to the tools they have available to serve and protect the community.”NEW JERSEY STATE POLICE TROOPER DIES AT HEADQUARTERS DURING TRAINING FOR ELITE UNITHCSO said deputies fired at the suspect, fearing for their lives. Researchers have found that a source of carcinogenic chemicals is in Americans’ cars – but there may be a way to reduce your risk.Environmental Science and Technology, a peer-reviewed scientific journal, published a study called “Flame Retardant Exposure in Vehicles Is Influenced by Use in Seat Foam and Temperature” on Tuesday.The study explains that Americans breathe in chemicals from the flame retardants in their vehicles. The chemicals can cause issues ranging from developmental neurotoxicity to thyroid hormone dysregulation and even cancer.The types of chemicals found in flame retardants range from polybrominated diphenyl ethers (PBDEs), which were common in cars until the early 2000s, to alternative brominated flame retardants (BFRs) and organophosphate ester flame retardants (OPEs). STUDY FINDS EVIDENCE OF MICROPLASTICS IN BRAINS AND OTHER ORGANSThe federal government requires a level of flame retardants in vehicles. The National Highway Traffic Safety Administration (NHTSA) mandated the use of flame retardants in the 1970s.”Flame retardant (FR) chemicals are intentionally used in electronics, furnishings, and building materials to meet flammability standards,” the study explains.STD RATES SKYROCKET AMONG AMERICANS 55 AND OLDER: CDC”Most [flame retardants] are used in an additive manner (i.e., not chemically bound), and many are semivolatile, indicating that they can be present in both the gas phase and partially in the condensed phase (e.g., particles and surfaces), depending on environmental conditions.”Americans who drive professionally or face long commutes may be at a higher risk of harm from the chemicals.”These findings highlight that commuters are likely to be exposed to [flame retardants], especially those with longer commutes or those who drive vehicles full time as part of their employment,” the paper read. “In addition, children, who breathe a greater amount of air per kg body weight compared to adults, would also be at risk of greater exposures for equivalent commuting times.”CLICK HERE TO SIGN UP FOR OUR HEALTH NEWSLETTERDrivers and passengers in warmer states may face a greater risk of breathing in the flame retardant chemicals. FIRST ON FOX: The prosecutor from Manhattan District Attorney Alvin Bragg’s office leading the questioning of adult film actress Stormy Daniels in former President Trump’s criminal trial had donated to President Biden’s campaign in 2020 and a number of other Democrat politicians and organizations over the years, Fox News Digital has learned. Prosecutor Susan Hoffinger questioned Daniels on Tuesday as she testified as part of the unprecedented criminal trial of a former U.S. president.Trump defense attorneys told Judge Juan Merchan on Tuesday afternoon that they would motion for a mistrial amid Daniels’ “prejudicial” testimony. Hoffinger said the claim was without basis, and Merchan ultimately denied the defense’s request. EX-TOP BIDEN DOJ OFFICIAL NOW PROSECUTING TRUMP WAS ONCE PAID BY DNC FOR ‘POLITICAL CONSULTING’Hoffinger’s donations to Biden came during the 2020 Democrat presidential primaries, Federal Election Commission records show. Hoffinger donated $500 to Biden’s presidential campaign in 2020: a donation of $250 in February 2020 and another donation of $250 in March 2020. She donated more than $900 to ActBlue during the 2020 cycle. ActBlue is an online fundraising platform for Democrat candidates, progressive organizations and nonprofits.The prosecutor also donated to a number of other Democrat congressional campaigns in 2020 and 2018. Colangelo left a senior role at the Biden Justice Department to join Bragg’s team. Bragg afterward brought charges against the former president in April 2023, raising questions among some in the GOP about alleged politicization of the case.House Republicans are investigating Colangelo and his past work as he prosecutes Trump.According to Federal Election Commission records reviewed by Fox News Digital, DNC Services Corp/Democratic National Committee paid Colangelo twice on Jan. 31, 2018. Colangelo was given two payments of $6,000, for a total of $12,000.The “description” for the purpose of payment is labeled “Political Consulting.”Neither the Manhattan District Attorney’s Office nor the DNC responded to Fox News Digital’s request for comment about Colangelo’s work.At the time, Colangelo was serving in then-New York Attorney General Eric Scheiderman’s office as the deputy attorney general for social justice, assuming the role from Bragg who, at the time, was appointed as chief deputy attorney general.Schneiderman resigned in May 2018 amid allegations of sexual assault. Barbara Underwood replaced him as New York attorney general.Just months after Colangelo received the payments from the DNC, in June 2018, Underwood, with Colangelo as executive deputy attorney general, filed a lawsuit against the Trump Foundation. The lawsuit alleged that Trump used the foundation’s charitable assets to pay off his legal obligations. Perez was DNC chair at the time Colangelo was paid for “political consulting.”TRUMP PROSECUTOR QUIT TOP DOJ POST FOR LOWLY NY JOB IN LIKELY BID TO ‘GET’ FORMER PRESIDENT, EXPERT SAYSColangelo also worked as a deputy assistant to then-President Obama and as the deputy director of the White House Economic Council.Bragg charged Trump with 34 counts of falsifying business records in the first degree. Trump pleaded not guilty to all counts. A charge of falsifying business records is typically a misdemeanor, but Bragg, Colangelo and New York prosecutors must convince the jury that Trump falsified those records in the furtherance of “another crime.”Prosecutors suggest that the other crime was in violation of a New York State law: conspiracy to prevent or promote election. On its face, as a stand-alone offense, that charge is also typically a misdemeanor.Coupling the alleged falsification of business records with alleged prevention or promotion of election becomes a felony crime, according to Bragg.
